INSURANCE BROKERS' CODE OF PROFESSIONAL CONDUCT
The brokers, members of the Association of Polish Insurance and Reinsurance
Brokers' gathered on May 31st, 1998 at the Congress in Sobieszewo do hereby
declare to accept this Charter, called the Sobieszewo Charter.
Considering that one of the basic rules binding each of the
Association Members is to act within the limits of the Law, the
brokers also accept that honest and ethically proper behavior are
essential and necessary to preserve good repute and sense of integrity
of the profession.
The Members of the Association consciously and voluntarily consider
as ethical the following norms:
I. I. When dealing with the Client the broker acts:
- in good faith, with due respect for the Client, using his or her
professional knowledge, always in the best interest of the Client.
II. II. When dealing with other brokers:
- each Member of the Association, as equal among the equals, enjoys
respect of the broker community
- undermining good name or reputation of other broker is treated
as action aimed at the entire broker community
- all practices and actions undertaken to achieve profits dishonestly
or at the expense of another broker will be chastised by the entire broker
community.
III. III. When dealing with the Insurance Carriers:
- Broker, through his involvement and professionalism, skillfully uses his
knowledge, acts honestly - having as his goal to secure the best and properly
understood interest of the Client.
Members of the Association of Polish Insurance & Reinsurance Brokers who
accepted this Charter, do hereby declare:
- Broker - member of the Association - acting according to the rules
stated in the Code of Ethics may always count on support and protection
from the entire broker community;
- Broker who acts in violation of the commonly accepted rules of
ethics and honest behavior, not only towards other brokers, Clients or
insurance companies but also towards any third parties, will be declared,
for the good of the broker community, as a person not deserving membership
in the Association of Polish Insurance & Reinsurance Brokers; this
reaction of the professional community is irrespective of any official
proceedings or other actions undertaken in such instance as prescribed
in the applicable law.
CODE OF ETHICS OF INSURANCE AND REINSURANCE BROKERS
The Code sets standards of professional ethics for the members of the
Association of Polish Insurance & Reinsurance Brokers.
It contains the most basic general norms of business ethics and the
commonly recognized norms binding professional brokers in the interest of
all parties involved in transacting and executing insurance contracts.
Hearing and review of the legal actions brought against the brokers
and claims resulting from their professional errors or from nonprofessional
acts belongs to the competence of courts and other official institutions.
The Ethics Commission established by the Association reviews complaints
and motions brought to its attention due to nonprofessional and/or
unethical acts of the Association members .
Insurance and Reinsurance brokers - members of the Association - adopt
the general norms of ethical behavior as stated in this Code and accept
them as governing rules in their professional activity.
Non-compliance with the rules stated below may be declared by the
Ethics Commission as unethical and may result in application of penalties
as stated in the Association's bye-laws.
FUNDAMENTAL NORMS OF BUSINESS ETHICS
- Brokers act in the interest and for the benefit of their Clients;
- Brokers perform their duties in good faith, lawfully and in
observance of rules of fair competition;
- Brokers care for their good reputation and the good image of their profession;
- The relations between brokers are founded on principles of equality and mutual respect;
- · Careful selection of personnel, proper organization of work and quality control of
every broker's business serve to safeguard delivery of competent and responsible services
to the clients;
- All statements made by the broker or on his behalf, including public
announcements, will be clear and precise so that they are not misleading;
- In performing their business activities the brokers are mindful of
principles of fair trade in relation to all other persons and business
entities.
